AUCTION CLOSING DATE: 11 AM (Hawaii Time) FRIDAY DECEMBER 11TH. Bidding on the first item in this sale will close at 11AM EST, and the sale will then close at a rate of 5 items per minute in catalog order until bidding on all items has closed.

 

INSPECTION DATE: Thursday December 10th from 10am - 4pm

 

REMOVAL DATE: Monday-Friday December 14th-18th 9am - 4pm (IMPORTANT NOTICE! Buyers who wish to utilize the slab and stone loading equipment at StoneWorld must make schedule an appointment for equipment use. Because of limited personnel and equipment only 10 slabs can be loaded per hour. Buyers are welcome and encouraged to bring there own equipment to facilitate loading. Details for scheduling will be posted on your sales receipt.

 

DEPOSIT: A $100.00 registration deposit must be made before a bidder may participate in this auction. This deposit may be made via Visa or Mastercard. PLEASE NOTE THAT THIS DEPOSIT IS ONLY AN AUTHORIZATION FOR $100.00, NOT A CHARGE. The authorization will only remain on a bidder's credit card for the length of time that the bidder's credit card company holds authorizations. Successful auction purchases are a separate transaction, so if a bidder makes no purchases that bidder will have no charges made against the bidder's account.

 

SALES TAX: Sales tax will be collected.

 

AUCTIONEER: "Auctioneer" refers to auctionsinhawaii.com and Rasmus Auctioneers.

 

TAX EMEMPT BIDDERS: If a bidder is tax exempt, the tax-exempt bidder must download and fax a copy of the appropriate state's tax-exempt form to Auctioneer at 703-823-5587 PRIOR TO THE CONCLUSION OF THE ONLINE AUCTION. If an online auction's assets are located in the state of Maryland, tax-exempt a bidders must apply directly to the state of Maryland for a refund, as Maryland does not accept out-of-state exemption forms.

 

IMPORTANT: TAX-EXEMPT A BIDDERS MUST FAX A TAX FORM FOR EVERY SALE IN WHICH THE BIDDERS PARTICIPATE. THIS FORM MUST HAVE THE BIDDERS' BIDDER NUMBERS AND THE SALES' CLOSING DATES CLEARLY NOTED. Forms without this information will not be accepted and bidders will have to apply to the state for a refund. Forms are not kept on file.

 

CAUTION: For demonstration purposes various items may be physically connected to one another on-site and/or pictured together in certain photographs. Do not assume a lot consists of more than one item simply because multiple items are physically connected or pictured together. Please inspect all lot numbers and read all descriptions.

 

CATALOG DESCREPENCIES: Bidders are bidding on items as described, not as pictured, Occasionally an incorrect photo may be displayed. Always read all item descriptions.

 

WARRANTY & CONDITION OF ITEMS SOLD: All items are sold AS IS, WHERE IS, WITH NO WARRANTY EXPRESSED OR IMPLIED by the lot number affixed to the item. This sale is to the business community as "equipment" and "inventory" without any implied or expressed warranty. Descriptions are believed to be accurate but are not guaranteed. When a bidder is not certain of the condition or use of an item, the bidder should bid accordingly.

 

CHOOSE WISELY: The Auctioneer wants everyone to get a good deal and most bidders will. However, when bidders bid on the wrong item or decide an item is not suited for their intended use, Auctioneer's clients are not willing to assume the cost of bidders' mistakes. When in doubt about condition, completeness, or suitability for intended use, please bid accordingly.

 

BIDDING ERRORS: Please be aware that many bidders routinely increase their own bids to price an item out of reach of other bidders. A bidder should immediately review all bids before submitting them. IF A BIDDER MISTAKENLY INCREASES HIS OR HER OWN BID, places his or her bidder number in the bid field, or makes a gross error, the bidder must IMMEDIATELY contact Auctioneer by email using the contact sheet on Auctioneer's website. Auctioneer will not reverse bids that have caused another bidder to be outbid; a bidder in error must remain the high bidder. If a bidder bids on the wrong item, Auctioneer will not reverse a bidder's bid. Auctioneer will not reverse bids after the auction has begun to close. No exceptions will be made to these rules. REVIEW ALL BIDS BEFORE SUBMITTING THEM.

 

BUYBACKS ON BEHALF OF SELLERS: In the event that a seller withdraws an item from an online auction prior to the close of the auction, Auctioneer may leave the withdrawn item on the catalog and buy the item back on behalf of the Seller in order to establish Auctioneer's earned commission and buyer's premium

 

STAGGERED CLOSING: The online auction closes at a rate of 5 items per minute. This feature works with the dynamic closing feature to closely emulate a 'live' auction.

 

DYNAMIC CLOSING: The closing time of an item is automatically extended an additional 4 minutes whenever a bid is placed within the last 4 minutes of the item's closing time. Thus, if an item is set to close at 2:00pm, and a bidder places a bid on the item at 1:58pm, the item's closing time will be extended to 2:02pm. If another bid is placed at 2:01pm, the item's closing time will be extended to 2:05pm, and so on.

 

BID NOTIFICATION: If a bidder has been outbid, that bidder will be notified by email until the close of the sale. To quickly review bids and to check on an item's status, bidders may utilize the 'review bids' feature. Items on which bidders have been outbid will be clearly marked.

 

WINNING A BIDDER NOTIFICATION: A bidder will be notified of winning bids by email ONLY. Bidders are responsible for checking a their email. If a bidder feels that he or she has won an item but has not received an email notifying them of a winning bid, that bidder must notify Auctioneer by email no later than 9am the day after the auction closes. If a bidder does not receive a paid email invoice, then that bidder did not win any items at the online auction.

 

BUYERS PREMIUM: A 15% buyer's premium will be added to each purchase. Thus, if you bid $100.00 you will be charged $115.00 at check out.

 

PAYMENT: Accepted forms of payment include Visa and MasterCard. A bidder must have an available balance on his or her credit card to cover that bidder's online purchases. At the conclusion of the auction, the credit card number that bidders have provided in connection with their bidder numbers will be automatically charged for the entire amount of their purchases. If a bidder has 2 failed attempts to process his or her charges, that bidder will have their bidding account suspended and will be required to provide a $1000.00 cash deposit to be held in escrow for 1 year in order to reactivate their account.

 

A BIDDER LIABILITY: A bidder agrees to be held personally responsible for all purchases made using his or her bidder number. Bidders authorize Auctioneer to release bidders' assets to any individual in possession of a bidder's sales receipt.

 

REMOVAL OF ASSETS FROM SALES SITE: Bidders are responsible for their own removal. Removal shall be at the expense, liability, and risk of the bidder. Purchases will be released upon presentation of a paid email receipt. Signature of Auctioneer's onsite master sales catalogue will constitute proof of delivery of items. It is important to ensure that movers or anyone picking up items on a bidder's behalf have that bidder's paid receipt at the pickup location. NOITEMS WILL BE RELEASED WITHOUT A PAID EMAIL RECEIPT.

 

DO NOT BID IF YOU ARE NOT ABLE TO PICK UP YOUR ITEMS during the scheduled removal times. WE DO NOT SHIP and NO refunds will be granted and no chargebacks will be honored if a bidder fails to remove items that a bidder wins at this auction. Once the scheduled removal period has elapsed, items not removed will be considered abandoned.

 

ABANDONMENT: Any item NOT picked up and/or paid for by the close of the removal period set forth at the head of these Terms and Conditions will be considered abandoned. IMPORTANT! The Auctioneer will have the option of reselling, removing, storing or disposing of items not picked up and/or paid for during the removal period set forth at the head of these Terms and Conditions. Bidders agree to pay all deficiencies and legal, collection, transportation, storage, and disposal expenses associated with delinquent accounts or abandoned items. Bidders further agree that bidders will not charge back items which are not picked up during the removal times set forth at the head of these Terms and Conditions.

 

SUSPENSION OF BIDDING PRIVELAGES: A bidder who does not remove his or her items during the removal period set forth above will have his or her bidding privileges suspended, and will be required to contact Auctioneer to reactivate his or her account. (2) occurrences will result in permanent suspension of bidding privileges.

 

BIDDER DEFAULT: In the event of a bidder default and/or chargeback, the erring bidder agrees that Auctioneer may collect payment for items - including the costs associated with items' storage, relocation, or disposal - either by means of a collections agency, judgments from arbitration and/or judgments from Small Claims Court as Auctioneer sees fit. Bidders further agree that any judgments awarded may be applied to bidders personally or corporately.

 

REFUND POLICY: In the event an item is not available for pickup, a bidder must notify Auctioneers's onsite staff and file a claim by replying to that bidder's original emailed invoice. In a bidder's claim, the bidder must note which items were not available by indicating their item number(s). A bidder's claim must be filed within 24 hours of the end of the removal period set forth above. After 24 hours, bidders agree that no adjustment or refund will be made.

 

DAMAGE: Any damage that a bidder, his agents, or his charges cause during inspection or removal periods must be made good by the bidder causing or responsible for those who caused the damage. Bidders agree that the credit card associated with a bidder's a bidder number will be charged for any expenses and/or repairs to the sales location or to the property of the seller or of another a bidder.

 

RIGHTS OF THE AUCTIONEER: Auctioneer reserves the right to add or remove items from the online auction, split or combine lots, add minimum bids or reserve prices, cancel, suspend, extend, or reschedule an individual item and/or auction event, and make changes to the auction's closing, inspection, and/or removal times

 

CLAIMS: Any controversy or claim arising out of or relating to this contract and/or agreement, or breach thereof, shall be settled either in Small Claims Court if the dispute in question amounts to less than $5,000, or by means of arbitration in accordance with the Commercial Arbitration Rules of the American Arbitration Association if the dispute amounts to more than $5,000. In the event of arbitration, judgments upon the award rendered by the arbitrator(s) may be entered in any court having jurisdiction thereof. Venue in either case will be Fairfax County, Virginia.

 

LIABILITY: Auctioneer's and Sellers' liability shall be limited to the refund of a bidder's purchase price.

 

LIMITATIONS: The above-stated Terms and Conditions of Sale may not be altered except in writing by the Auctioneer.
